‘Company’, ‘management’ ‘us’ or ‘we’ means Amazing Discovery Sdn Bhd (Company No. 961344-H). ‘Guests’ or ‘you’ means in-house guests who stay overnight and/or day-guests who do not stay overnight.
- Boulder Valley Glamping Sites (“the Site”) is operated by Amazing Discovery Sdn. Bhd. (Company Registration No.: 961344-H)
- Glamping is an outdoor experience that you can get with camping without most of the uncomfortable factors like toilets, electricity, water supply and food being eliminated. Nonetheless, the guests must be well aware that what Boulder Valley Glamping Sites (“the Site”) offer is still an outdoor activity with a stay in a tent and as it is a call of the wild, Guests must be prepared for certain degree of challenges/ discomfort/ risks in a natural environment setting.
- To preserve the wildlife, flora and fauna in their natural environment, it is not possible to eliminate risk totally as the Site is physical in nature and paths and walkway can be uneven in places and in wet conditions some surfaces may become slippery. The Guests must ensure that they exercise caution when staying/ entering/ visiting/ driving to the Sites.
- There are no conditions, warranties or other terms, express or implied, including as to quality, fitness for a particular purpose or any other kind whatsoever, that are binding on the Company.
- It is important for you to note that in places like that you may experience high winds, falling branches, land slide or heavy rain making the ground too wet or unfit for certain activities you may have planned in advance. As we have no control over the weather, the Company will not be held liable for any compensation, damages, losses or claims whatsoever but will always do our best to help in such event.
- The Guests are not allowed to bring in outside food and drinks and shall not use any lighting, heating, cooking or other gas or electrical appliances of any kind, other than what is provided for and appropriate to use, inside the Company’s tents without the previous consent in writing of the Company. No cooking or use of gas appliances of any kind should be used inside the Company’s tents.
- The Guests are not allowed to bring in outside food and drinks and shall not use any lighting, heating, cooking or other gas or electrical appliances of any kind, other than what is provided for and appropriate to use, inside the Company’s tents without the previous consent in writing of the Company. No cooking or use of gas appliances of any kind should be used inside the Company’s tents.
- The Guests is responsible for any damage and loss caused to appurtenances belonging to the Company regardless of culpability, and therefore should any security deposit be insufficient to cover costs incurred by the Company, the Guests will be liable for all costs associated with this damage and/or loss and payable upon demand by the Company.
- No animals/pets are allowed inside the Company’s tents, without the previous consent in writing of the Company.
- Guests shall not invite any other person to tents or areas where the in-house guests are allowed to access other than the Guests that the Company is being notified on as in-house guests. However, the in-house guests are allowed to bring in other person as day-guest to areas accessible to day guests only subject to day-guests charges and other terms and conditions applicable to day-guests. As such, please take note on the signage placed at the Site.
- The tents and/or Site shall be occupied/utilized by the Guests for lawful purposes or activities only and Guests are not allowed to bring in explosive and illegal items or materials into the Site.
- It is not advisable to bring infants below 3 years old to the Site. Children of age 12 and below must be accompanied and supervised by parents or guardians at all times who shall be responsible for the safety of their children. The Company shall not be responsible for the safety of the children.
- The Company does provide services to the Guests such as assisting to book/purchase tickets for other tourist attractions and arrange for transportation subject to Guests giving advance notice and further subject to any terms and conditions as may be imposed by the Company from time to time as the Company deem fit. Such services are also subject to payment of management fee as determined by the Company from time to time. It must be noted that the Company merely assist the Guests to book/purchase tickets and arrange for transportation to make the Guests as convenient as possible when staying in the Site and the Company is in no way making any warranty or representation whatsoever in relation to such assistance and shall not be responsible for including but not limited to any substandard services of other tourist attractions and transportation.
- The Guests shall indemnify and keep indemnified the Company for any claims brought by or on behalf of the Guests for any actions, proceedings, claims, costs, charges, expenses, demands, death, injury, illness, losses and/or loss/damage to Guests’ property against The Company.
- The Company will not be liable for any: Act of God including but not limited to tempest, fire, flood, storm, natural disaster, landslide, falling branches or poor weather conditions; War, civil war, sabotage or act of terrorism; Government sanction; Labour disputes, including strikes, lockouts, boycotts or other industrial action; Failure in the transportation of equipment, machinery or personnel or in the provision of any utility including power, gas, water, or communication services, and any other factor outside of the reasonable control of the Company.
- You should also note that as the facilities at the Site are subject to availability, on first-come first-served basis and depends on the weather, the experience you gained may not be the same as what you see from the videos available in our website.
- Please do not bring valuable items to the Site and/or leave your items unattended. The Company shall not be responsible for loss of any valuable items and/or personal items.
- The Guests shall ensure that all the terms and conditions herein stated, including the exclusion of liability and obligations on their part are made known to any persons occupying/staying/visiting/invited under the Reservation of the Guest including the Guests’ Invitees/Relative(s)/ Dependant(s)/ Friend(s)/ Employee(s) and are to be performed by the Guests, the Guests’ Invitees/ Relative(s)/ Dependant(s)/ Friend(s)/ Employee(s) and/or any persons occupying/staying/visiting/invited under the Reservation of the Guest.
- As the Site is located in a natural environment, we ask that you enjoy and appreciate the beautiful surroundings and you take every care not to remove, pick or eat plants growing on the Site.
- Please throw rubbish at designated places failing which you shall bear the costs incurred for our collection of rubbish thrown outside of the designated places.
- The Company may close certain areas for certain events, weddings or for reason of bad weather or whenever the Company consider circumstances so require without prior notification.
- All the facilities available at the Site and provided by the Company such as barbecue pit and other appurtenances are subject to availability and on first-come first-served basis. The Company have the right to reserve such facilities and appurtenances for the Company’s use or events as the Company deem fit.
- Any intentional/unintentional damages/misuses/vandalism and/or removal/taking of the appurtenances of the Company, the Company at its discretion reserves the right to charge/claim against the Guests the full/replacement/repair value of the appurtenances on or before the check-out/visiting or within 15 Days subsequent to the Guests check-Out/ visiting date by notifying the Guests via email of the charge/claim and payment so demanded shall be paid by the Guests within fourteen (14) days from the date of such request failing which the Company shall have the right to charge late payment interest of 10% on the amount due and payable calculated on daily basis until the date of actual payment.
- Guests arriving by own transportation/vehicle at the Site must exercise caution when driving/maneuvering on Site private road/path and/or if assistance is required from The Company’s employees to maneuver the vehicle on Site’s private road, The Company and/or the Facilitator accept no responsibility for damage/loss/injury to vehicles and/or the Guests whilst driving/maneuvering/ parking on the Site private road/grounds. Driving/maneuvering/parking the vehicle in/at the Site are at the Guests’ own risk.
- If the Site or any part thereof is unsuitable for occupancy/stay/visit due to unforeseen circumstances on/before/during the specific duration, the Company reserves the right to terminate the reservation and the Company shall refund the reservation deposit paid by the Guests based on prorated value of unoccupied specific duration and the Company shall not be liable for any compensation, loss or damages whatsoever in relation thereto.
- The Guests agree and shall allow the Company’s employees or contractors to enter the tent and/or any areas within the Site at reasonable time for purposes of cleaning/repair/maintenance/replace necessary items during the term of the Reservation.
- You are permitted to take photographs and recordings within the Site provided that these are solely for private use and are not sold or used for any commercial or public purpose. By entering the Site. From time to time, the Company or other authorised parties carry out photography and/or video recording in the Site, which may feature guests. By entering the Site, you accept that the Company or any authorised party may use such images in any promotional, advertising or publicity material in any form whatsoever.
- There will be no refund and/cancellation allowed for payment made for any reservation and/or online booking. However, you are allowed to one (1) time change of date at least ____ days prior to your arrival date subject to availability of tent. In the event there is an increase of rate after the first reservation date, any change of date will only be allowed subject to availability of tent and top-up payment for the increased rate.
- By making reservation and/or proceed with the online booking with us and/or by entering the Site, you are deemed to understand and accept all the terms and conditions herein contained in our website.
- We reserve the right to change, revise or modify our terms and conditions as and when we deem fit without prior notification.
- This shall be governed by the law of Malaysia.
